{"id":507,"date":"2015-05-25T00:10:25","date_gmt":"2015-05-24T23:10:25","guid":{"rendered":"http:\/\/willowhayne.org\/vortex\/?page_id=507"},"modified":"2022-04-13T20:00:00","modified_gmt":"2022-04-13T19:00:00","slug":"building-applications","status":"publish","type":"page","link":"https:\/\/willowhayne.org\/?page_id=507","title":{"rendered":"Building Applications"},"content":{"rendered":"<h4><img loading=\"lazy\" decoding=\"async\" class=\"alignright wp-image-965 size-large\" src=\"http:\/\/willowhayne.org\/vortex\/wp-content\/uploads\/2015\/06\/Building-1024x326.jpg\" alt=\"Building\" width=\"604\" height=\"192\" data-id=\"965\" srcset=\"https:\/\/willowhayne.org\/vortex\/wp-content\/uploads\/2015\/06\/Building-1024x326.jpg 1024w, https:\/\/willowhayne.org\/vortex\/wp-content\/uploads\/2015\/06\/Building-300x95.jpg 300w, https:\/\/willowhayne.org\/vortex\/wp-content\/uploads\/2015\/06\/Building.jpg 1258w\" sizes=\"auto, (max-width: 604px) 100vw, 604px\" \/>Building applications<\/h4>\n<p><strong>General<br \/>\n<\/strong>In\u00a0 the\u00a0 interest\u00a0 of\u00a0 residents,\u00a0 there\u00a0 are\u00a0 covenants\u00a0 on\u00a0 all\u00a0 Estate\u00a0 properties, which\u00a0 include\u00a0 the requirement\u00a0 for\u00a0 additions\u00a0 and\u00a0 alterations\u00a0 to\u00a0 be\u00a0 approved\u00a0 by\u00a0 the\u00a0 Willowhayne\u00a0 Residents\u2019 Association\u00a0 (WRA)\u00a0 Limited.<\/p>\n<p>If you wish to build, alter or extend any\u00a0 building\u00a0 within\u00a0 your property\/garden or wish to make an excavation for a garden wall, drive etc., then you should apply for written consent from the WRA before proceeding with the work.<\/p>\n<p>In order to save you time and money, it is recommended that whilst producing your proposed plans you take note of the existing covenants in your Deed of Title to enable your proposal to comply with the covenants. \u00a0The WRA will consider your application based upon these criteria.\u00a0\u00a0 Additionally, once your plans have been finalized it is recommended that your proposed plans should be discussed\u00a0\u00a0 with\u00a0\u00a0 immediate\u00a0\u00a0 neighbours.<\/p>\n<p>Please\u00a0\u00a0 note,\u00a0\u00a0 that\u00a0 the WRA\u00a0\u00a0 will\u00a0\u00a0 only\u00a0\u00a0 consider proposals\/plans for residents who are fully up to date with their Estate Rates payments.<\/p>\n<p>All charges quoted apply from 1<sup>st\u00a0 <\/sup>January 2022 and may be subject to annual review.\u00a0\u00a0 The Board members ask all residents to co-operate with them in their efforts to try to maintain and improve the Estate for the benefit of all.<\/p>\n<p>The\u00a0 WRA\u00a0 welcomes\u00a0 the\u00a0 opportunity\u00a0 to\u00a0 provide\u00a0 help\u00a0 and\u00a0 advice\u00a0 early\u00a0 on\u00a0 in\u00a0 any\u00a0 planning procedure.\u00a0\u00a0\u00a0 Should\u00a0 you\u00a0 have\u00a0 any\u00a0 queries\u00a0 associated\u00a0 with\u00a0 the\u00a0 scope\u00a0 of\u00a0 the\u00a0 work\u00a0 to\u00a0 be undertaken, please contact Hobdens Property Management Ltd.\u00a0 for advice (email \u2013\u00a0<u><a href=\"mailto:willowhayneplanning@hobdensmanage.co.uk\">willowhayneplanning@hobdensmanage.co.uk<\/a><\/u>\u00a0 or phone 01903 724040).<\/p>\n<p>Building alterations have been categorised by the WRA in four ways:\u00a0 Small, Medium, Large Building works\/New Builds, and Landscape works (dependent upon the volume of materials being moved).<\/p>\n<p><u>Note:<\/u> All work is to be started within three years of the approval date, and once started must be completed within one year from the start date with the exception of \u201cMajor refurbishments and\u00a0 extensions\u201d\u00a0 and\u00a0 \u201cNew\u00a0 Houses\u201d,\u00a0 which\u00a0 must\u00a0 be\u00a0 completed\u00a0 within\u00a0 three\u00a0 years.\u00a0\u00a0 In the event of a delayed start date, the charges levied will be at the rate current at that time.<\/p>\n<p><strong>Charges<br \/>\n<\/strong>Building and landscape works involve a considerable amount of wear and tear on our roads and it is unfair that the Estate as a whole should bear these costs. Although for some small works no charge would be made, charges are levied for all other works.\u00a0 These charges come in three parts: Administration Charge, Road Use Charge, and a Deposit against damage to the Estate.<\/p>\n<p><u>Administration\u00a0Charge<br \/>\n<\/u>This covers the general administration of the project and must be paid at the same time as the application to WRA.<\/p>\n<p><u>Road charge and returnable deposit<br \/>\n<\/u>These <strong>must <\/strong>be paid after initial discussions with WRA and before the commencement of any work.<br \/>\nThe deposit will be refunded upon satisfactory completion of the project less the cost of any damage to the Estate roads and verge as specified by WRA.\u00a0 Any repair costs in excess of the deposit must be paid by the applicant.<\/p>\n<p>All works in the categories below will require to be approved or otherwise by the Planning Committee.\u00a0\u00a0\u00a0 Any\u00a0 contentious\u00a0 decision\u00a0 will\u00a0 require\u00a0 to\u00a0 be \u00a0discussed\u00a0 at\u00a0 the\u00a0 next\u00a0 scheduled WRA full Board meeting where a decision will be given and any decision made by the WRA is final.<\/p>\n<p>When\u00a0 the\u00a0 plans\u00a0 have\u00a0 been\u00a0 given\u00a0 provisional\u00a0 approval\u00a0 by\u00a0 the WRA,\u00a0 the\u00a0 applicant\u00a0 must\u00a0 sign\u00a0 a formal contract \u2013 an exchange of letters \u2013 with the WRA, agreeing to simple conditions as listed below. For major works, a traffic management plan must be agreed in advance with the WRA in order to minimise disruption to estate residents and visitors.<\/p>\n<p>On completion of the work the applicant must advise WRA, who will then check the road\/s, verges etc. to assess any damage before refunding any part of the deposit. There will also be an external visual inspection of the completed work to ensure it complies with the approved plans.<\/p>\n<p><strong>Categories of Work<br \/>\n<\/strong>Categories are broken down as follows:-<\/p>\n<p><u>Small\u00a0Building\u00a0Works<br \/>\n<\/u>The majority of the applications to WRA come under this category, some are chargeable and some are not.\u00a0 There is no intention to charge for minor internal works and there is no need to contact WRA in these cases, e.g.\u00a0 kitchen\/bathroom\u00a0 refurbishment,\u00a0 erections\/replacement\u00a0 of sheds for the sole purpose of storing garden tools or any project when two skips or less of hardcore\u00a0 have\u00a0 been\u00a0 produced\u00a0 (12\u00a0 cu.metres\u00a0 of\u00a0 waste).<\/p>\n<p>Where more than two skips or a \u201cGrab-lorry\u201d is used, additional cost will be levied. However, internal structural redesign of a property should be notified to WRA to assess if a charge is applicable.<\/p>\n<p>These projects would generally come under the category of works which may not require the local authority\u2019s planning consent but may require building regulation approval. These can be, by\u00a0 way\u00a0 of\u00a0 an\u00a0 example,\u00a0 porches,\u00a0 conservatories,\u00a0 single\u00a0 storey\u00a0 rear\u00a0 additions,\u00a0 roof\u00a0 shape changes,\u00a0 recladding,\u00a0 new\u00a0 front\u00a0 walls,\u00a0 driveways,\u00a0 small\u00a0 rear\u00a0 patios\u00a0 and\u00a0 small\u00a0 gardening landscapes (this is not a complete list but if you have a query you should discuss this with Hobdens Property Management Ltd).<\/p>\n<p><u>Medium\u00a0and\u00a0Large\u00a0Building\u00a0Works<br \/>\n<\/u>These\u00a0 are\u00a0 significant\u00a0 works\u00a0 and\u00a0 usually,\u00a0 but\u00a0 not\u00a0 always,\u00a0 require\u00a0 local\u00a0 authority\u00a0 planning consent and building regulations approval.\u00a0 Examples of such works are: large landscaping and\u00a0 medium\u00a0 to\u00a0 large\u00a0 patios,\u00a0 medium\u00a0 to\u00a0 large\u00a0 extensions,\u00a0 loft\u00a0 extensions,\u00a0 garages,\u00a0 major modifications and rebuilding, and swimming pools etc.<\/p>\n<p><u>Exceptional\u00a0Building\u00a0Works<br \/>\n<\/u>The\u00a0\u00a0 exception\u00a0\u00a0 to\u00a0\u00a0 the\u00a0\u00a0 above\u00a0\u00a0 will\u00a0\u00a0 be\u00a0\u00a0 for\u00a0\u00a0 substantial\u00a0\u00a0 refurbishments,\u00a0\u00a0 completely\u00a0\u00a0 new developments\u00a0 or\u00a0 those\u00a0 where\u00a0 an\u00a0 existing property is to\u00a0 be\u00a0 demolished\u00a0 and \u00a0a\u00a0 new\u00a0 property built.\u00a0\u00a0\u00a0 Related\u00a0 legal\u00a0 and\u00a0 survey\u00a0 fees\u00a0 (should\u00a0 a\u00a0 survey\u00a0 be\u00a0 required\u00a0 by\u00a0 the\u00a0 Board)\u00a0 will\u00a0 be payable by the applicant.\u00a0 Note:- With a new house or if substantial and significant structural alterations are proposed, the WRA may require a Deed of Covenant and Consent to be entered into by the applicant with the applicant paying the fees of WRA\u2019s solicitor.<\/p>\n<p><u>Landscape\u00a0Projects<br \/>\n<\/u>This includes all projects that require substantial movement of materials including soil to and from a property.\u00a0 Examples of this are: major garden projects or where two or more skips or a \u201cGrab-lorry\u201d are\/is used.<\/p>\n<p>In all cases, even if local authority approval is not required, you will be required to send a copy of the\u00a0 plans\u00a0 and\u00a0 drawings,\u00a0 together\u00a0 with\u00a0 a\u00a0 covering\u00a0 letter\u00a0 explaining\u00a0 your\u00a0 intentions.\u00a0\u00a0 These should\u00a0\u00a0 be\u00a0\u00a0 sent\u00a0\u00a0 to\u00a0\u00a0 Hobdens\u00a0\u00a0 Property\u00a0\u00a0 Management\u00a0\u00a0 Ltd.,\u00a0\u00a0 (Address:\u00a0\u00a0 41a\u00a0\u00a0 Beach\u00a0\u00a0 Road, Littlehampton, West Sussex, BN17 5JA) with a cheque in their favour.\u00a0 The basic charge for this work is given in the schedule attached and covers Hobdens administrative costs.\u00a0\u00a0 Please note, it is not possible in this document\u00a0 to give precise cost for this work as this will vary depending\u00a0 upon\u00a0 your\u00a0 requirements,\u00a0 but\u00a0 on\u00a0 submission\u00a0 of\u00a0 the\u00a0 plans\u00a0 to\u00a0 WRA\u00a0 we\u00a0 would\u00a0 be pleased to provide a detailed costing.<\/p>\n<p>These plans would be discussed by the Planning Committee and, if considered appropriate, your neighbours will be consulted.\u00a0 Should objections be received from consulted neighbours, these will be considered by the WRA.\u00a0 If the WRA considers any objection to be valid, then this\u00a0 will\u00a0 be\u00a0 discussed\u00a0 with\u00a0 the\u00a0 applicant\u00a0 to\u00a0 see\u00a0 if\u00a0 a\u00a0 satisfactory\u00a0 solution\u00a0 can\u00a0 be\u00a0 found. However,\u00a0 it\u00a0 is\u00a0 emphasised\u00a0 that\u00a0 it\u00a0 is\u00a0 not\u00a0 within\u00a0 the\u00a0 WRA\u2019s\u00a0 mandate\u00a0 to\u00a0 get\u00a0 involved\u00a0 with neighbour disputes and any decision made by the WRA is final.<\/p>\n<p>The\u00a0\u00a0 Planning\u00a0 Committee\u00a0 will\u00a0\u00a0 endeavour\u00a0\u00a0 to\u00a0\u00a0 approve\u00a0\u00a0 plans\u00a0\u00a0 within\u00a0 two\u00a0\u00a0 weeks\u00a0\u00a0 of\u00a0\u00a0 the consultation procedure finishing, but the time-scale is dependent upon the complexity of the\u00a0 project\u00a0 and\u00a0 provided\u00a0 there\u00a0 are\u00a0 no\u00a0 objections.\u00a0 If\u00a0 there\u00a0 are\u00a0 neighbour objections,\u00a0 or\u00a0 the Committee\u00a0 is\u00a0 not\u00a0 unanimous,\u00a0 your\u00a0 application\u00a0 will\u00a0 then\u00a0 be\u00a0 passed\u00a0 to\u00a0 the\u00a0 full\u00a0 Board\u00a0 for consideration, which will take longer.<\/p>\n<p>Formal Approval will only be given once all charges have been paid and WRA has received the signed copy of the terms and conditions.\u00a0 Only after the applicant has received the Formal Approval from WRA is work permitted to commence.<\/p>\n<p>On\u00a0 the\u00a0 completion\u00a0 of\u00a0 the\u00a0 work\u00a0 the\u00a0 applicant\u00a0 must\u00a0 advise\u00a0 WRA,\u00a0 who\u00a0 will\u00a0 then\u00a0 check that the completed works are in accordance with the approved plans and check \u00a0the road\/s, verges etc. to assess any damage before refunding any part of the deposit. engaged in activities beyond the scope of the above charges and deposits, the WRA will seek to recover the cost of repairs from the vehicle operator.<\/p>\n<p>Residents are encouraged to support the WRA in doing so, by notifying Hobdens of any incidents where damage has occurred, together with the relevant details, to enable the vehicle to be identified.<\/p>\n<p><strong>Building Supplies Left in the Road <\/strong><strong>or on Verges<\/strong><\/p>\n<p>It is unacceptable to leave building supplies in the road or on verges, especially unlit and without any warnings. \u00a0If you are having building work, it is your responsibility to ensure that your builder\u2019s equipment and their supplies are kept on your property. \u00a0If there is an absolute need for the road or verges to be used you must ensure prior permission is obtained from the WRA and the materials are lit at night and with adequate warnings. \u00a0Any damage caused by materials left on the road or Estate owned verges will be charged to the property owner.<\/p>\n<p><strong>WRA standard conditions for building and landscaping approvals<\/strong><\/p>\n<ol>\n<li>All work is to start within three years of the approval date and, once started, is to be completed within one year from the start date. In any event all work is to be completed within four years of the approval date, with the exception of major refurbishments and extensions and new houses which must be completed within three years.<\/li>\n<li>All approvals for planning and building regulations required from Arun District Council must have been obtained and proof and copies thereof, and any other documents requested, supplied to the WRA.<\/li>\n<li>No building materials or equipment are to be left on any roads, footpaths and\/or verges on the estate. Any damage caused by the work must be repaired and made good. Any mud and debris must be cleared from the roads at the end of each day.<\/li>\n<li>Any vans, lorries and building equipment must be hosed down\/cleaned as necessary to avoid leaving mud on the roads.<\/li>\n<li>Contractors\u2019 vehicles must not damage roads, verges, trees, bushes, etc, and vehicles must manoeuvre in a safe manner at all times. Any damages caused to any neighbouring properties must be remedied in agreement with the offendee.<\/li>\n<li>All vehicles associated with the building works must be parked on your premises, unless prior approval has been obtained to park on estate roads.<\/li>\n<li>Dust nuisance must be kept to a minimum and areas where this is likely to happen must be dampened down, for example, where tile or paving cutters are used.<\/li>\n<li>Every effort must be made to minimise any nuisance or disturbance to neighbouring residents.<\/li>\n<li>Working by contractors on the estate is only permissible between 8am and 5pm Monday to Friday and 8am and 12 noon on Saturdays. Such work is not allowed after 12 noon on Saturdays and is not permitted on Sundays or bank holidays.<\/li>\n<li>Playing radios and the like outside is prohibited. If played inside, they must not disturb other residents.<\/li>\n<li>Deliveries related to the work are not allowed outside the hours of 8am and 5pm Monday to Friday and 8am and 12 noon on Saturdays. Deliveries are not allowed after 12 noon on Saturdays and are not permitted on Sundays or bank holidays.<\/li>\n<li>Bonfires are not allowed.<\/li>\n<li>Contractors must observe the 20mph speed limit on Willowhayne Estate roads.<\/li>\n<li>No hoarding, sign or advertisement other than an estate agent&#8217;s sale board may be displayed on your property. The temporary display of a tradesman&#8217;s sign in a discreet fashion is acceptable whilst work is in progress provided it does not cause an obstruction or impair the visibility of pedestrians and road users. The sign must be removed within three days of the work being completed.<\/li>\n<li>No commercial vehicles may be parked on your land (except within an enclosed garage) once contractors have left your premises.<\/li>\n<li>Current and future estate maintenance charges must be paid for your home on the estate. This applies to any year during which this work is in progress.<\/li>\n<li>No caravan, motorhome, mobile home or office facility, or shipping container may be parked anywhere on your property except under specific agreement with, and prior approval by, the WRA.<\/li>\n<li>If there is a need for a portaloo, it must be sited in an inconspicuous location and screened from the road in a location agreed in advance with the WRA.<\/li>\n<li>Skips should only be placed on the property&#8217;s own driveway or garden. If this is not feasible, the WRA must be contacted for prior approval to place the skip on the verge outside the property.<\/li>\n<li>Contractors must hold public liability insurance as appropriate and supply documentary proof to the WRA on request.<\/li>\n<li>Contractors must provide a copy of their health and safety policy to the WRA and comply with the relevant health and safety legislation at all times.<\/li>\n<li>To avoid excessive wear to the estate roads and prevent damage to any utility&#8217;s infrastructure, contractors must not use vehicles exceeding a maximum gross vehicle tonnage of 26 tonnes. This may mean multiple deliveries or collection of equipment or material to ensure the loaded vehicle weight does not exceed the limit.<\/li>\n<\/ol>\n<p><strong>Questions we are often asked<\/strong><\/p>\n<p><strong>\u201cIf I am having building works, what are the rules on contractors\u2019 signage?\u201d<\/strong><\/p>\n<p>Contractors\u2019 work signs should be removed within a short time (usually less than three days) after the work is completed.\u00a0 If signs are not removed within this timescale, the WRA may remove and dispose of them (with no recourse).<\/p>\n<p><strong>\u201cHow do I know what planning applications have been received by the WRA?\u201d<\/strong><\/p>\n<p>If you are considered a \u2018consulted neighbour\u2019, Hobdens will write to you advising you of the application and ask for your comments\/feedback (if any) to be advised within a set period of time. Not all works require neighbour consultation. If you are not considered a \u2018consulted neighbour\u2019, you will not be advised of any such applications.<\/p>\n<p><strong>\u201cHow do I know what planning applications have been submitted to Arun District Council?\u201d<\/strong><\/p>\n<p>Arun District Council updates its website on a weekly basis with details of submitted planning applications. To view these applications, you need to simply check Arun\u2019s website using the following link:<br \/>\n<a href=\"http:\/\/www.arun.gov.uk\/weekly-lists\" target=\"_blank\" rel=\"noopener noreferrer\">http:\/\/www.arun.gov.uk\/weekly-lists<\/a><\/p>\n<p><strong>\u201cCan I put temporary posts on my verge to protect it during nearby building work\u201d<\/strong><\/p>\n<p>The WRA will allow residents opposite a house with building works to put temporary posts, flags or cones on the edge of the verge outside their house to dissuade construction and other vehicles from driving on the verge.<\/p>\n<p><strong>\u201cCan I put a shipping container on my property during building works for storage\u201d<\/strong><\/p>\n<p>No shipping containers or other storage units are allowed in gardens or on driveways or verges during building works without prior approval from the WRA<\/p>\n<p><strong>\u201cCan I build a shed in my front garden?\u201d<\/strong><\/p>\n<p>In accordance with property covenants, no sheds or other outbuildings can be installed in front of the existing building line of the property.<\/p>\n<p><strong>\u201cDo I need permission for a skip on my property?\u201d<\/strong><\/p>\n<p>Owners must advise Hobdens in advance if a skip is to be delivered to their property and the purpose for it unless it is in accordance with WRA building or landscape approval already issued (so the WRA can check no approvals or fees under the buildings and landscaping approvals policies are required). For pedestrian safety and convenience, skips must only be placed on the property&#8217;s own driveway or garden. If this is not feasible or would result in additional on road parking, the owner must contact WRA for prior approval.<\/p>\n<p><strong>\u201cAre swimming pools and hot tubs allowed on the Estate?\u201d<\/strong><\/p>\n<p>Residents must minimise noise nuisance from pool machinery (pumps, filters etc.) by selection of equipment, location and sound-proofing and from bathers during use. In the event of noise nuisance you will need to report it to the Council who are obliged by law to investigate all noise \/ nuisance reports.
